In BC if you each had the kids equal amounts of the time they way you would calculate what to pay would be as follows:
If she had the kids full time you would pay her $982.
If you had the kids full time and she earned $35K then she would have to pay you $543.
So, if you had the kids equally you really only had to pay $439.
You also had to pay 65% of the extra fees.
If you had them more than 60% really she had to pay you $543.
So, she's been well ahead.
She is obligated to work. If she does not the Court would impute income and the income it would impute would be what she's been earning.
She is getting a good deal but then again it probably benefits your boys.
At this point it's now up to you to decide what you feel is best for all of you.
