It's illegal to work and there's no way around it. If you work and you are caught you will be deported and the whole PR application will be denied. It's a very risky move.

If you do not have a SIN card and then want the company to use an incorporation number the company will know what you are doing don't you think? They cannot do that anyway. If you are an employee they have to deduct CPP and EI and taxes.

It's not about the SIN card and when you get it. You cannot look at this as a un-legal period. It's an illegal period. It's a crime to work without a work permit. It's grounds for deportation.

You can contact the Law Society and use their Lawyer Referral Service. You will be given the names of three lawyers and can consult with any or all of them and the first half hour will be free.

An employer has legal obligations. They are required to deduct money from your paycheque. They cannot hire illegal workers. They cannot hire an employee and not remit the appropriate deductions to the various governmental agencies. It's against the law. It's not just about how they pay you.

What I mean is that you aren't waiting for a SIN card. If you were that would be different. You are not allowed to work here. That's very different. It's a crime for you to work here now.

Also, I don't know where you get the idea that you will have your PR status in one month. You will first need to get approval in principle and then will get the PR status a few months after that in a likelihood. When you get the approval in principle you can then get an open work permit.

But speak to an immigration lawyer just in case. You can do that for free through the lawyer referral service.

It's not just one month and the risk is enormous as you face deportation if you are caught.

An employer needs to submit payments on your behalf to the various governmental agencies if you are an employee. It's a requirement.

The out of country sponsor process is faster. The last person I was involved with just got hers this morning. She called me to let me know. It was from the States and it took her 13 months and there were no hitches at all. She has about 4 - 6 weeks more to wait for her PR card.

About two months ago she as granted approval in principal and she received an open work permit a short while ago.

I don't know how people get caught. I am lawyer and can only explain the law and now what I've seen. The people that get away with working illegally get paid under the table and the employer knows what's going on.

I really cannot provide more information than that. You may not get caught of course. can just explain the consequences if you do.

That's your choice of course. If you don't accept I just don't get paid. I take that chance when I answer a question.

Usually I do get paid, especially when I spend so much time on a question and answer so promptly. Most people don't agree with your point of view that if the law isn't the way you want it or there isn't an answer then the lawyer doesn't get paid but I guess once in a while this is how it goes on this site.
