If your union rep won't assist you then I really don't think you have any choice but to consult with an employment lawyer because I can see that what you need is this defamatory accusation to be removed from your file and it doesn't sound like you feel there's much chance of this happening without your getting some outside help.

You have a right to be heard and to provide your position. If you feel that they are going to place something in your record without first affording you the chance to respond then you should either assert your rights on your own or get lawyer to do so for you.

You have documentary back up for your position and this is strong evidence that cannot and should not be taXXXXX XXXXXghtly.

So see if the rep agrees or not. Perhaps the rep does not yet see how important this is to you.

Then after that decide if you need to at least consult with a lawyer. You can do this privately and no one need know.

What you can do to find a lawyer is one of the following things.

You can contact the Law Society and use their Lawyer Referral Service. You will be given the names of three lawyers and can consult with any or all of them and the first half hour will be free.

Or you can check on a site called lexpert. This is a legal directory of leading lawyers and law firms throughout Canada and is well-respected by the legal community.
