The sale is in transition as we speak. She wanted to gift the house to her family before selling it, for tax purposes, and allowing the family to do with it as they wish.

The seller is definitely out of the loop at this stage. That is why she needs the advice. She is 86 years old and was told by one of elderly friends, she should have gifted the house to her kids if she didn't need the income or money.

She wants to go and live in an assisted home ,which her pension income will pay for, which also leaves her with sufficient income to live on at her age.

There is no blatant fraud about this question whatsover, and we don't appreciate the comment.

We were hoping things would be clear to you by now and that you would have answered back as we were already prepared for your non legal advice.

Your prior answer should have been an outright no, or yes it could be under certain/or these circumstances before accusing her of blatant fraud.

The legal system is full of grey areas, (a lawyer the type of person most aware of), and these grey areas should not only be available for translation to the rich.

We have done further research and found that real estate laws in our province differ from Ontario.

Although in my mind, your last response was a valiant effort to try and answer our question in a positive manner, it differed with my mothers opinion. She believes it was damage control. She got the answer to her question elsewhere. She is an 86 year old strong willed woman, and she decides who pays the bill as it was her money being fronted for the initial question.

As it is her money, and her request,she feels the response was untimely and unacceptable
