For a contract of the type to be upheld in Court it has to be clear that your mother understood what the contract meant and what she was giving up. For this reason these contracts can (and in some provinces absolutely will) be set aside if your mother didn`t have her own lawyer explain the law and what she was giving up when she signed it.
This is why there is a need for financial disclosure. It`s about fairness. How can she sign a contract and it be fair if she doesn`t even know what it is she is signing away?
