VerifiedIs there a court order between them regarding child support? When was the order made and how much is he ordered to pay?
Where do you live?
The father should definitely get this back into court as soon as possible to change what the order says to what he should be paying. Two thousand a month or more is a very large order for two children, so either your friend makes a lot of money or there's a spousal support component and extraordinary expenses as well. But that's not what you asked me.
A bankruptcy will not get your friend out of court ordered support payments. He'll still be on the hook for that amount unless and until a family court changes what he owes. The support recipient cannot come after you for father's support monies owed. It is possible for her to claim the monies from you and ask a court to make an order that you pay it, but that's an extraordinary thing to try to do.
You'll be fine. Father needs to bring a motion to change the final order back to court as soon as possible.
