This is a fact situation.

The gentleman lives in Edmonton, Alberta, he was born in Milano, Italy, on the 7th fo July 1925 and is still alive; he emigrated to canada in 1967 and received Canadian Citizenship in the 70's. He was in full time employment and paid taxes to the Canadian Government.

The child that was adopted by the third party has nothing to do with him, in fact it appeared on the horizon in the late 90's, this child has children of her own, which the gentleman's wife recognises as her grandchildren.

The gentleman has two natural children, one from an un-married relationship, one from a married relationship. he never adopted or maintained any of his current wife's children.

The issue is that not that he leaves everything to his wife, but he makes no provision for his natural children on second death, if he is to go first, and leaves nothing to his natural children, whom he maintained until the age of 18, if he is the second to die.

The second natural child's mother die in the mid 90's, but she remarried and eventually divorced before kicking the bucket....if you excuse the expression.

OK, i think that if we put names to people, and extplain a bit further we might get to hopefully an acceptable answer.....please note I will eventually accept and pay the fee!

John has a sexual/romantic relationship with Mara, he is Italian, she is South African.

John knows he has made Mara Pregnant and invites her to go to Italy to give birth to Alex, a boy, in 1963. In Italy the legislation about parental responsibility is quite clear, married or not, if the father is on the birth certificat he is the main parent!

Eventually Mara is sent packing and, because of the above, John takes full responsibility for Alex, providing him with a roof over his head, food on the plate and pays the fees for Alex's education.

In 1962 John meets and marries Nadia, who begets his a son by the name of Max in 1963.

John divorces Nadia in 1973, during the marriage he has provided for Max.

Nadia eventually marries then divorces than dies, leaving her total estate to Max....please not that she was Alex's stepmother, and as such provided Alex with love and moral support.

John meets Fernande, a divorcee with an adult daughter, Natalie, from her previous husband.

When Fernande was young, under 18, she fell pregnant and gave birth to a daughter, also named Natalie (wierd to name the second one the same). Being a Quebequoise Roman Catholic her family arranged for the bastard child to be adopted, Fernande lost contact with the first child until, in the mid 90's, when Natalie#1 tracks her down, and appears on the scene with husband and children.

Natalie#2 has a family of her own, husband and children, and was never adopted by John.

In 2005 John and Fernande draft a mirror will in which they leave everything to each other, then on second death all to go to the grandchildren of Fernande, totally excluding Max and Alex, and their children, from benefitting from John's and Fernande's Estate.

Please note that when John and Fernande married, Fernande's wealth consisted of debts which John cleared her of.

Surely this will can be challanged!
