Because of the casual nature of the agreement, it is uncertain as to whether this would be construed as a validly enforceable contract. One of the elements of a contract is that the parties must intend to be bound. If I say to my wife, "I will give you $1000 if you just stop nagging me" and she stops nagging me, does that entitle her to $1000 as a matter of law? No, because neither one of us reasonably intended to be bound by the agreement. A similar argument can be made by the business owner that she was just joking and that she didn't actually intend to give you a percentage of her business just because you gave it a name. It is very unlikely that you will get a percentage of this business.

On the other hand, a court may award you some reasonable flat fee for your creative efforts on the basis of unjust enrichment. This is not certain, but it a possibility.

In the end, for this particular transaction, it may be best to try to negotiate the best amount you can and move on. It may not be economically feasible to litigate given the uncertainties and risk involved.

For the future, you should draft a simple contract that spells out all of the terms of the agreement. Include a description of the service you are going to provide, the price, the time lines involved, the names of the parties, etc and all other important terms. Get both parties to sign. This way, the agreement is memorialized, the parties cannot be said to have made the agreement as a joke, etc, and you can enforce.
