Immigration will not be able to force him to sponsor you and if he doesn't your application for permanent residency cannot be processed under the sponsorship class. However, you may be able to ask for Humanitarian and Compassionate consideration based on the fact that you are left in the lurch because your husband had an affair and you have a year old Canadian daughter.

There are also other ways that you can immigrate such as coming in as a professional or skilled worker or if you've had work experience in Canada before you can come under that class as well.

If you can afford an immigration lawyer, it would make sense to retain one now.

If you can't the what you can do is to call the Law Society of Upper Canada and use their Lawyer Referral Service. You will be given the names of three lawyers. You can consult with any or all of them and the first half hour will be free.

If you provide them with all the details of your life in Canada and back home they may be able to suggest, based on those facts, what the best route to take is.
