VerifiedYou have to serve him with the notice of application for custody before the Court will hear the matter. Even if you get sole custody your child cannot be adopted unless he consents of the Court agrees to waive his consent. That will be a second issue to deal with down the road, unfortunately.
You can't get a passport or travel across the border unless you have either custody or his signs the passport application and gives you a letter that gives you permission to travel so you are right about these concerns.
If he wants access it will be tough to convince the Court that it's not in your child's best interests to allow him to be in her life.
He should be paying child support. Perhaps he won't care about any of this so long as he thinks he's free from that obligation?
