VerifiedThere are no set rules that relate to how long someone needs to be kept in the hospital. In this case they had ruled out a brain injury. Obviously there was an error.
Your friend cannot sue for a breach of some rule.
Your friend can sue if there is evidence of negligence. It's hard to know from these facts and it would be hard for your friend to know if there was negligence.
Also, you didn't mention anything about any harm he suffered as a result of the error. If there wasn't any harm then there are no damages to speak of and no point in suing because even if the hospital was negligent, and your friend then wins in Court it will likely cost him more to sue than what, if anything, he would be rewarded.
If there was in fact harm caused by the error then your friend may want to consult with a medical malpractice specialist.
