You are entirely incorrect. If someone causes you harm out of their actions or their negligence they are most certainly liable for any damages caused.

Firstly, insurance doesn't preclude you from civil liability. For example, if you have $1,000,000 in insurance to cover slip and fall situations and someone was severly hurt and claims damages over this amount you will be on the hook for the money over $1,000,000.

Secondly, because of deductibles and skyrocketting insurance rates once there has been a claim, most people are careful not to immediately file a claim for damages with their insurance companies. This is why if someone hits your car they may offer to pay for all the damage themselves so that you don't file a claim with your company because car insurance works a bit differently and the person who is at fault will incur the higher insurance rate.
