VerifiedThe landlord has a duty to make the premises habitable. This duty runs from the beginning to the end of the tenancy.
Habitable means the premises meet the Minimum Housing and Health Standards under Alberta’s Public Health Act and Housing Regulation.

Based on your facts it seems that the landlord is not meeting the basic standards.
Also, the landlord is responsible for keeping the premises reasonably safe and in good repair at all times.

- To recover damages

- To end the tenancy
But you cannot withhold rent because you believe the landlord is not meeting their obligations.
A landlord cannot evict a tenant for exercising their rights under the Residential Tenancies Act or the Public Health Act.
Also, instead of retaining a lawyer to assit you, you may go another route.
You can consider trying to use what is called the Residential Tenancy Dispute Resolution Service. This Service provides you a means for resolving serious issues without the need for Court.
