You clearly have some understanding of the law. Given your experiences so far I am sure you have come to realize that nothing is simple and straightforward in family law matters.

Child support, as you correctly point out, is calculated by the tabled amounts which are based on income.

However, under appropriate circumstances, a Court will impute income when there is no actual income. They will do so in cases where the payor isn't working but could be working or was working and just stopped for no reason etc.

If the father in the case stopped working because he has that money from the house and doesn't want to pay child support the Court will very likely just impute the income he was earning as income for child support purposes.

It might be a good idea to simply inform the father of this and indicate that he has until August 1 to commence payments going forward and then provide him with a suggested schedule of how he will bring the arrears up to date.

If that doesn't work one letter from your former lawyer might to the trick. Otherwise, I am sorry to tell you this but you may have to retain the lawyer to fight for this for you and your child.

But you could go about seeing what will happen if you do try and enforce the agreement. It may be that they will seize money from his account and you will be able to get some money but he will ultimately fight that, as you likely have figured out. He will say that he lost his job... and therefore has no child support obligation for the time being.

The one thing that is on your side at enforcement office is that they've seen and heard this all a zillion times and there is no sympathy for fathers who act this way.
