VerifiedBased on the facts that you are providing I would say that you should consult with a lawyer who specializes in employment issues. If the demotion is not based on valid grounds you could argue that this is a case of constructive dismissal and sue the company for wrongful dismissal. What I am saying, in more simple terms, is that this demotion may be view by the Courst as if the company actually fired you.
If they are not firing you for cause you will be entitled to significant damages because given the years of employment with this company you are likely entitled to significant salary in lieu of notice (severance pay) because you've been working for there for 34 years.
Also, if the demotion (constructive dismissal) is based on your depression then you can argue that their behaviour is discriminatory on the basis of disabily. In that case, along with suing you could file a complaint with your provinces Human Rights Commission.
I urge you to retain a lawyer immediately and do not agree with the company about anything until you get legal advice. You could, however, tell them just that, that is, that you are getting legal advice and you or your lawyer will advise them of your position shortly. They may rethink their decision after hearing that.
