Family Law Custody Child Support. Alberta, Canada Two
Won final order for primary Custody September 2020, Ex moved to Town in February 2021 and demanded Shared Parenting to get out of child support. Tensions rose with lawyer attempted to fire and hire new council, lawyer refused as duty to finalize final order. stopped providing legal advice and manipulated me into signing opposing councils bare bones final order. Opposing party would not file stated it was judges responsability, my lawyer finally told me they are no longer my council. went to courthouse and they called opposing council, opposing council emailed justice for direction. justice signed and directed opposing party to file. final order granted september 2020 finally filed september 2021. summer holidays was 50/50 now opposing party is wanting to draft a consent to vary for shared. Current child support order is shared based on interum order with opposing party paying based on set income for 2020 with arrears, registered with MEP. Opposing party registered for recalculation, I'm self employed as well-deadline october 16,2021. I want to know how best to go forward. Do i put the final order to use and after a summer of 50/50 go back to 70/30 even if she lives in town.? Will that make me look like i'm restricting her time unecessarily. To me shared parenting means shared responsability and she hasn't explained how she is going to provide for the children. She states she was going to get a job, then now shes "in school part time online" no proof. Her income tax will be low, she moved in with her boyfriend and he is supporting her. She says wants shared with a no child support order and will say that we have currently been living a 50/50 shared parenting and that she wants it to reflect that but then she will probably ask for child support because I worked and will have higher income tax return.… read more
