You are common law spouses if you live together in a marriage-like relationship and either it has been for at least two years or you have a child together.
So you have lived together for more than two years and do have a child together so you are common law spouses unless you've really been living together only as roommates.
If you are in a interdependent relationship where you make decisions together, hold yourselves out as being a family, have some financial interdependence then you would clearly be considered to be common law spouses.
If you are living together with a child then generally there is no need to prove anything more and would not need documentation.
