There are no automatic rights to property division, in a common-law relationship in the province. The law is different with respect to married spouses. But in a common law relationship, a claim can only exist if the non owning spouse can prove that they made contributions towards the property that have helped to acquire, improve or maintain it, and have not already received some form of compensation for those contributions. The amount of the claim would be the value of those contributions, and not any set percentage such as 50%.
Even with a common law relationship, there is an obligation on both parents to provide financially for any children.
And if they were common law for at last three years, then there can be a requirement for the higher earning spouse to pay spousal support to the lower earning spouse. If they have children together this obligation to pay spousal support can exist earlier than three years.
