Okay. There are no automatic rights to property division, in a common-law relationship in the province. The law is different with respect to married spouses. But in a common law relationship, a claim can only exist if the non owning spouse can prove that they made contributions towards the property that have helped to acquire, improve or maintain it, and have not already received some form of compensation for those contributions. The amount of the claim would be the value of those contributions, and not any set percentage such as 50%.
So to be entitled to any portion of the home, you would need to prove the extent of the contributions that you made. But even proving though that you made payments towards utilities and other household expenses, this may not be sufficient to result in any sizable award, because you receive the benefit of course of living in the property at such times. It would be a matter of comparing the amount of the payments and contributions that you made, to those made by or spouse. If he was making much larger payments towards the mortgage, insurance, property taxes, and repairs and maintenance, the court would likely say that you received fair compensation already for the payments that you made by virtue of living in the property.
So I think it is correct to say that it is possible and you could receive some amount from home. But this is likely to be quite minor.
