VerifiedYour husband having disappeared would be grounds in Canada of a divorce once you have been separated for a year, but it would not be grounds for an annulment. An annulment is rare, as proof is needed that the marriage was never legal in the first place such as due to one or both spouses not having proper mental capacity to get married, or one spouse being physically unable to consummate the marriage and that was unknown to the other spouse. But once being legally married, a spouse leaving or running off is not grounds to annul. ...It is possible to apply for a divorce in Canada even without being able to locate the other spouse. A court can dispense with the need to serve the other spouse if you can show you have made all reasonable efforts at locating him. I hope this is helpful.
