This is not about what is in the Act.
It's how our legal system works.
If there is an order and then the parties go back to Court and a new order is made about the same issue, the new order is the one that stands, not the old one.
So it's like a custody order, for example. If custody is changed, the new order is the one that matters and the old is null and void.

I think you can say that there was an error made when a new order was made after the matter had already been adjudicated and decided.
