FOR DEBRA THAL: QUESTION (again) WHAT APPROACH IS MOST EFFECTIVE…

The TRIAL (as far as the ORIGINAL NOM is concerned) is HER attempting to secure the custody of kids 100% and give me only supervised visits based on past mental health issues.

If it's adjourned I think it just saves her money in lawyer fees.
For me, I can make a N.O.M. to see the kids, but I want this awash in attention by the courts.

She is the kind of person to try this over and over each couple of years.

She tried for custody in 2011. The result was that the judge gave us 50% legal sharing of custody.

I have not seen or TALKED TO my kids in over months.
It was suggested in the FCC that my wife and I work the visits out.
My pastor emailed her to let her know he will be the "supervisor". he was ignored several times.

I didn't put forth a NOM demanding that she allow me time.

I find the "supervised" visits for me are humiliating, given my experience as a good father, so I attempted to simply focus on the end goal: "normal" life as it was. Boy, me writing that brings to home the abnormal circumstances.**sorry, type-0.

I haven't seen or talked to the kids since the beginning of January.

So, I need to organize this into the proper form.
IF I UNDERSTAND CORRECTLY:

1. AFFIDAVIT. ALL FOLLOWING INFO ON ONE AFFIDAVIT:
> STATE, YES, THE ADJOURNMENT IS FINE UNDER THESE CONDITIONS:
a) I am allowed normal custody restored.
> STATE THAT IF THE NORMAL CUSTODY ARRANGEMENT CANNOT BE RESTORED, THEN WE MUST GO TO THE TRIAL PROCESS.
> DESCRIBE THE SENSE OF URGENCY, SINCE I HAVEN'T SEEN MY KIDS.

....and SHOULD I STILL PUT FORTH ANOTHER AFFIDAVIT WITH ALL THE INFO I SCANNED AND SENT TO THE LAWYER ALREADY, AS A FORMALITY AND DUE-PROCESS????

Is it ok if I submit only the AFFIDAVIT TODAY, WRITTEN IN THIS FORM (AND ANOTHER TOMORROW THAT INCLUDES THE EVIDENCE...SINCE IT WILL TAKE TOO MUCH TIME AND THE COURT WILL CLOSE IN 2 HOURS)?

"I know or believe the following facts to be true. If these facts are based on information from others, I believe that information to be true.

I make this Affidavit in relation to XXXXX filed on June 24th, 2013, ASKING FOR ADJOURNMENT of the:
1. Pretrial on July 8th, 2013
2. 3 Trials on August 21, 22, & 23 2013.


My answer is a conditional “yes” with the following terms:

1. My access to and status with my 2 young children, Kees Martin Cruz-Vanderkraan,
(Birthdate August 23, 2006) and Kiara Francesca Cruz-Vanderkraan (Birthdate January 24, 2010) be completely restored so that I have 50% shared guardianship in that they will live with me 50% of the time.
2. This access and status will be effective immediately.

If Joanna Cruz-Vanderkraan is not in agreement with these terms then I do not agree with an adjournment, since the pretrial July 8th, 2013 and the 3 trials on August 21, 22, and 23 2013 are obviously necessary.

If the above conditions cannot be met, then the pretrial is an urgent necessity, since my kids and I need to be together sooner rather than later.

Also:
It is challenging not to view this requisition as a stalling tactic, since I have provided every reason, including the results of a Mental Health Assessment to Joanna Cruz-Vandekraan to accept me as a normal healthy parent.
I've attached here more information that is relevant in showing my strengths as a father, and also why in part I was concerned about the character of Joanna Cruz-Vanderkraan in the first place.
May this information shed light on the truth that exists.

LAST YEAR WHEN JOANNA TRIED TO TAKE CUSTODY, I SUPPLIED PHOTOS OF BRUSING, BITE MARKS, A WHOLE LIST OF ISSUES OF CONCERN. THE JUDGE DENIED JOANNA, AND LOOKED AT HER SQUARELY, AND SAID, 'YOU CAN DO BETTER'.

THIS YEAR, THE FILE DOES NOT HAVE THAT SAME SET OF PHOTOS AND INFORMATION.

IS IT A GOOD STRATEGY TO SUBMIT THIS AGAIN, EVEN THOUGH IT'S OLD INFO?

I BELIEVE SHE CALLS ME CRAZY AS A DEFLECTION TACTIC.

Ok, but there's a part of me that wants this info floating around the courthouse for ALL TO SEE ...as PUBLIC as possible, as a strategy to surround the kids with safety.

I'm concerned about something regarding Monday's PRETRIAL.

As far as I understand so far, Joanna's "Requisition" for Adjournment is only that, a requisition.

I was assuming that we all STILL SHOW UP FOR THE TRIAL ON MONDAY JULY 8TH,2013, and THERE AND ONLY THERE THE JUDGE WILL GRANT -- OR NOT -- THE ADJOURNMENT.

JOANNA JUST SENT ME AN EMAIL IN RESPONSE TO INFO I SENT HER IN PREP FOR THE PRETRIAL.
IN HER EMAIL SHE SOUNDED PANICKED. SHE SAID, "THE PRETRIAL IS ADJOURNED"

WHO IS RIGHT HERE??

IS THE PRETRIAL ACTUALLY ADJOURNED NOW??
