During the last six months of marriage my wife experienced financial difficulty, she spends more than she brings in, she could not pay her share of many household expenses along with personal expenses and I agreed to pay the expenses as long as she would pay me back when the house was sold. We agreed and kept it out of the settlement, i have her email agreeing to pay the itemized account. When the house was sold and we each got a cheque, she refused to pay me. Our separation says everything - expenses - have been agreed to, we did not include the loan as it would have one more item to list and have lawyers examine, we established a personal loan, from me to her and I did it in good faith, fully expecting her to repay it. That was two years ago, I recently filed in small claim and I now have a court date coming in July. I submitted our marriage contract, and subsequent records, along with the itemized email of her expenses and her agreement to pay me. What we have here is a personal loan established outside of any Family Law Act, a personal loan to cover many expenses. Do I have a valid case. Her rebuttal was simply that all expenses have been covered under the Family Law Act and she has said nothing about her loan or subsequent email confirming the pay back.
