I am not really clear about what your concerns are. Why would you be screwing yourself by getting your ex to pay child support?

The law is exceedingly clear and he is required by law to pay child support.

He should have been paying it from the moment you separated.

This is not discretionary.

Child support is the right of the child. You can immediately apply to court for a court order for child support and he will be required to pay it. In fact, you should be seeking a retroactive amount for the past three years.

The court will often go back for up to three years to make a retroactive order for child support.

Your children are not supposed to suffer because their father is not paying support. He has to.

And, the amount he has to pay is not even discretionary.

He will be required to make full financial disclosure of his last three years financial situation including his income tax returns and assessments for the past three years.
