This query is re: CA Probate Law and Real Estate. Query:
Query: Firstly, there's a CA living trust, where the settlor had died, and the settlor's son and his wife are living in the settlor's home (manufactured home) (which is the sole asset in the trust). The settlor has lived there for 20+ years, and the son and wife moved in 10 years ago. This wife is a trustee and 1/3 beneficiary #1 (and also the executor of the estate). The son and trustee-wife have stated that they plan to remain living in the house indefinitely, as it's their home, as they've lived there for 10 years. I'm beneficiary #2 and I want them out of the house so that it can be sold, etc. This is the background, but it's not my question yet.Secondly and next, I called the mobile park, where the house is located to inquire about the asset-house. I informed management that the tenant / settlor had died, that the house was in a trust, and that the couple was living there. It appears that the management of the park a)didn't know about these tenants, b)that someone other than the settlor was living there, c) so the new tenants would need to fill out new rental agreement / contract to get qualified as tenants, and d)so the rent would increase by $1,500 per mo., since they weren't on the original lease / rental agreement and weren't grandfathered in to maintain the low rent status of the settlor.Thirdly and finally, Beneficiary #1 in an angry email to me Beneficiary #2, admitted that they were keeping the death of the primary tenant a secret from the Park so that the rent wouldn't change / increase.So, here goes my question: I have concerns about the "unethical" behavior of this couple and how it might affect the viability / value of the asset-house. I'll explain further. I'm worried that the Park may go against the asset of the Trust and recover damages or back rent (who know how far back!) and so go against the value of the House (by lawsuit, lien, etc.). In other words, has this couple's conduct, in any way jeopardized my rights as an heir / beneficiary to this House? … read more
