Hello, I have a question regarding a shared property fence. I live in San Jose CA. I live in a court and have 6 neighbors that border my property. Both the neighbors behind me have a concrete culvert on there side. The neighbor to the north has put a pipe that runs the length of his property and covered it with dirt and has a 24 inch retaining wall with the fence on top of that. His retaining wall and fence extend past my yard to my neighbor to the north, about 25 feet to the north and I have about 50 feet I share with them, the neighbor to the south just has a standard fence. The problem is that the retaining wall and fence with my next door neighbor that is shared with my neighbor to the back has fallen down, the 25 feet of fence. The neighbor behind me wants me to pay for 50 feet of retaining wall and fence, the only problem is the fence is still standing, the post are ok and every fence board is still in place. I have told him that the retaining wall is all his responsibility as it does not benefit my at all, I see it only as a liability. I have told him I understand his situation as the fence with the other neighbor has fallen but the fence between us is fine at this time. I've offered to pay a portion of half the cost of the fence only, but not the full price of half the cost which would be $820. I'm offering $300. From what I've seen on line about shared fences I know I'm responsible for half assuming that the fences are falling down, but it is still standing. What do you think on this matter? Thanks.
