Our company is a water authority. According to our state we are a not-for-profit political subdivision. We are eligible for municipal license plates, and a member of the state's public retirement program. Do we also qualify for the Federal Medical Leave Act? We currently have only 4 employees that operate our business.

I'm Doug, and I'm sorry to hear of the confusion. My goal is to provide you with excellent service today.

The Family and Medical Leave Act (FMLA) applies to all public agencies, regardless of size, and to all public and private elementary and secondary schools, and companies with 50 or more employees.

As your company constitutes a public employer, the company does not need to reach the 50 employee test before the Act applies. Here are a couple of links to information in this regard:
