Resolved Question:

Absolutely need a CA Labor Expert familiar with EDD

How long does a person have to file a UI claim from termination date?

If someone was last on UI in Sept of 2011 for a period of 60 weeks before getting a new job
and gets gets laid off again in August 2012 if they file the claim from the second job are they technically re-opening the past claim? Or does a new claim immediately start? Should the person wait till Oct of 2012 to file if it will start a new claim?

Thanks

A person has 14 days from the Friday after the person was terminated to file for a UI claim.

If the person is laid off again in August 2012, they would be starting a new claim, not reopening the prior claim, so the new claim would start.

Since the person has 14 days from the Friday after the person is terminated to file a claim, the person should file the claim within that time frame, as wating till October would prevent them from receiving unemployment benefits.
