I am involved in legal business litigation as a plaintiff.
I am involved in legal business litigation as a plaintiff. Our case was filed in July 2017. My question is whether I should seek another lawyer at this point because we are having some very diverse opinions regarding some crucial issues. As it is right now, I believe we are winning the case. We are for the most part in the discovery phase. The defendants are using stall tactics and are objecting about most everything we have instead of providing valid explanations. My attorney so far has done a very good job to this point in my view. But we are having a strong disagreement on proceeding with several issues: 1. We just received a response from a subpoena from an affiliate of one of the defendants showing that another affiliate lied on a previous subpoena. So I prepared myself a complaint to the county attorney a complaint for perjury. My attorney does not want me to file it because he says we need to focus on gathering information and that it wouldn't help my case. I am not seeing how this diverts focus since it is simply a matter of turning the complaint over to the county attorney and they handle it from there while putting added pressure on the affiliated defendant. There are a couple other issues that are similarly related to non action that would benefit the case but I will confine this discussion to this one issue for the sake of keeping it simple. So my question is should I seek another attorney to handle the case in midstream or should I stay the course? The perjury is clear cut, will put the affected parties on notice and in disarray. This is an extreme disagreement over the handling of the case. I could wait 30 days or so and file the complaint myself as an option. Thank you that's it. … read more
