Long story short.. we have a commercial trucking and swabbing business that is/was insured with PROGRESSIVE INSURANCE. We have been insured with Progresive for 4 years. During a Port of Entry inspection on one of our semi's, the Federal Motor Carrier Safety Association informed us that our insurance company had never filed the appropriate insurance paperwork with the Federal Motor Carrier division there for our
MC # (motor carrier #) had been revoked. This resulted in an "out of service" violation which resulted in our driver literally staying in the semi for two days unable to move from the port. The officer and the FMCSA both told us that we as a company, RPJ Energy is not at fault for this, that this is the insurance's company's fault for not filing. Progressive specializes in transportation/trucking insurance and knows this needs to be done when a policy is written and upon renewals. We lost revenue, had additional pay to the driver, had to pay fines and our driver now has a "tarnished" 30 year clean driving record. All of this does not even begin to mention the stress and amount of time that his taken on and from our company.
Within the same time period, Progressive insurance informed us that they are cancelling our insurance coverage because of 2 out-of-service violations that were not even mentioned in the 4 years that we have been insured with them. Though diligent work and time is being put into finding new insurance, the "new insurance company" (National Indemnity) has not provided a quote and we are now without insurance unable to move product, resulting in another great amount of revenue (including loss of wages for our employees because they can not work until this is all figured out) and time lost AGAIN.
We need help and advice on what attorney's we can contact in our area to start suing the people that are responsible for all of this and back us up. We have been in business, with great reviews and a great reputation and we need to be able to stand up for ourselves and other family companies out there. Situations like this cannot continue to happen to hard working individuals just because the insurance companies and government are so "protected."
Please advise as soon as possible.

Response: I am so sorry to read about your difficulties. Progressive Insurance is liable for damages you have suffered. Also, cancellation of your insurance appears to be retaliation for their mix-up and for knowing that you are going to go after them for not filing proper papers with FMCSA. You would need a local Attorney who handles insurance litigation on the part of the Plaintiff or an Attorney who handles commercial litigation to assist you with the case.
