If you answer a lawsuit with a motion to dismiss, how long does the other side have to file a motion in opposition? Federal Court

Kathie Russell :

They do not necessarily have to file awritten motion in opposition. They may file one, but they may just appear at the motion hearing and argue against the motion to dismiss without having submitted anything in writing.

Kathie Russell :

If they file an opposition in writing it must be filed within 14 days after they received the motion; you then have 7 days after receiving their opposition to file a response.
