Customer Question

We bought an automotive business 4 years ago. The previous owner didn't transfer the lease, claiming, he was grandfathered in. The lease is in his name, followed by, d.b.a. Sterling Car Care LLC. He sold Sterling Car Care LLC to us. Now he does not want to renew the lease for us, but wants the business location back (including our customers). The contract states: Purchaser understands that the lease to the business location atXXXXX Suite 317, Sterling, VA 20166, is not transferable and that the Perchaser is operating the premisses as Manager for Sterling Car Care LLC, which will be owned by Shareholder until the Note hereinafter set forth is paid in full, at which time Purchaser is solely responsible for the lease management.
Furthermore the business was sold with all equipment, and now we have a letter from his attorney, stating that the previous owner wants to come in and take inventory.
Do we have recourse? We are in VA

Best regards,

Do you have a bill of sale? Does the bill of sale list the equipment? Is the Seller also your landlord? Did you get an assignment of the membership interest in the LLC?
Was there a sale contract?
