If you resign from a comission based job and it is verbally

This answer was rated:

If you resign from a comission based job and it is verbally said that all comissions on complete orders will be paid, in full and any order still in process will be 1/2. All orders in email form. If the company sayes that they will not pay the comission on a complete order now 2 weeks later and the order delivered, is there anything that can be done.
If you were an employee, then you would have a wage claim and you would file it with the state department of labor. These types of claims are frequent because there is always an argument as to exactly when the commission is "earned" and due to be paid, so you will have to prove their oral agreement and past practices as to how they paid on these orders would be evidence you would use as to the agreement.
