They don't have to tell you whether your student loans were discharged or not. The presumption is that the student loans are not discharged. Like I said, you have to file a complaint with the bankruptcy court to get a determination of whether the student loan imposes an undue hardship on you. If the court finds that it does, then the loan would get discharged. Without getting that determination from the court, the presumption is that the student loan is not discharged. The test for undue hardship is quite stringent, so most people do not qualify to get their student loan discharged.

Also, the Dept. of Ed. would wait to collect during the bankruptcy due to the automatic stay that prevents them from taking any action to collect.

You said you filed in 11/98. Is that right or did you mean Nov. 2018?

It is really hard to say that your attorney messed up. Like I said, most people won't qualify for the undue hardship in order to get their student loans discharged. If you want to get that order, you would need to reopen your 1998 bankruptcy case. There is no time limit to do it, so, in theory, you could still do it. It will be up to the judge of whether you can reopen it. I would highly suggest you discuss this with a bankruptcy attorney.
