Customer Question
How do I know if...
How do I know if my debt is secured or not? I just filed chapter 7 and was told by my attorney to NOT reaffirm my debt on my commercial mower. He said that the likelihood of repossession was very low. When I financed the mower, nothing was said about this being a secured debt, but I saw it listed as secured on my credit report.Would appreciate a second opinion on this one. Thanks!

Further info on account... The finance company is Sheffield Financial, and the mower is a Husqvarna MZT-52, and I have had it for 2 years

Look through the paperwork from when you purchased the mower. If there was a "security agreement" signed regarding the financing then it is a secured loan because the mower was given as collateral.

You can also run a UCC search on your name with the secretary of state and it would show any financing statements filed in your name.
