how long or how many days from the date of filing a chapter 7 bankruptcy do the trustee or court have to set a 341 hearing , and is what are my options if a hearing is not set within the time limit.

generally it is set at least 30 days from the filing date, could be more if the court call is busy. The hearing date is listed on the 341 meeting notice of filing, so check there. You can call the clerk of the bankruptcy court too to confirm the date, or if there isn't one set, you can ask them what the holdup is. ThanksLet me know if you have any further questions.

i want to know if the bankruptcy code sets a definite limit on the time limit given to set a 341 hearing from date of filing and what is that time limit .

no they do not. for example, it was 3-4 months wait when the law changed back in 2005 since there were tons of last minute filers!Call the clerk, they'll give you the timeline. You need the hearing to get the discharge, so just be patient, but follow up with the clerk's office. they can help!ThanksTerry
