Bankruptcy Law Questions? Ask a Bankruptcy Lawyer.
Hi - my name is XXXXX XXXXX I'm a Bankruptcy attorney here to assist you.
If a debtor who filed a Chapter 13 can no longer afford the payments, that debtor has 2 options available:
1) The debtor can ask that the payments be reduced (if the debtor's income has decreased or if the debtor's expenses have increased).;
2) The debtor can have the case converted to a Chapter 7 (if the debtor otherwise qualifies for a Chapter 7 by being able to pass the Means Test).
I think this is what you wanted to know.
If not, please let me know. Thank you.
