Hi JACustomer,
Regarding your question about accountability for the non-filing ex-spouse, is this in reference to joint debts owed by both parties, or for debts only the filing spouse is responsible for?

By both parties

1) Yes - a debtor can file their own Bankruptcy any state - including in Utah. (A debtor can also pay a Bankruptcy preparer $200 to fill out the 60-page application for him or her.)

2) If only one ex-spouse files a Bankruptcy, the other ex-spouse will remain liable for those debts.

I think this is what you wanted to know. If not, please let me know.
