Hi - my name is XXXXX XXXXX I'm a Bankruptcy litigation attorney here to assist you.

California is a community property state, so any debt that you've incurred during the marriage would be your spouse's debt as well. Thus, filing bankruptcy individually would not get rid of your spouse's obligation to pay.

The only way to get a full release would be for both of you to file.
