Customer Question

I will be filing chapter 7 in Riverside California soon. I have lived in California (9 months)long enough to file there but must use Oregon "exemptions" under current law. However, which means test calculations must I use, Oregon or California? Can you use the means test numbers for the state where you currently reside and file, even though you are using another states exemptions?

Hi JACustomer,
Yes - you have to use the Means Test for the state in which you are currently residing, even though you are using the exemptions for another state.

I think this is what you wanted to know. If not, please let me know.
Thank you!
