my brother-inlaw is in the process of filing for bankruptcy.

my brother-inlaw is in the process of filing for bankruptcy. I'm not sure if it is Chapter 7 or 13. His father just gifted all of his children $12,500. He thinks by cashing the check out of state, they won't find out about it. I'm concerned that he is breaking the law and will be caught. What is the best course of action?
