Customer Question

our landlords filed ch 7 bankruptcy, it was discharged, we got notification from the irs. The landlord demands rent, we assume the mortgage holder will be contacting us soon. The landlord still damands rent payment, they claim they were able "to pick and choose which properties they could bankrupt and ours was one they kept", they posted a 3 day payment of rent demand. You are required to continue to pay the rent to the landlord until title changes hands. If the house is foreclosed your lease will survive the foreclosure. Here's why.

Under the Helping Families Save Their Homes Act signed into law on May 20, 2009, an occupant of a foreclosed home has 90 days after the sale to vacate unless the occupant has a lease. If the occupant has a lease, the lease continues after the foreclosure sale.
Good luck.
