My brother is filing bankrupsy and we have inherited a farm. Is my part of this farm protected in any way? How can I save the farm?

Thank you for your question.

Your brother's interest in the farm would be considered part of the bankruptcy estate. However your interest in the farm would not be considered part of the bankruptcy estate.

If your brother has not yet filed bankruptcy he may be able to disclaim his interest in the inheritance prior to filing. If he does disclaim his interest, the interest would pass as if he predeceased the decedent.
