Can a Forensic psycologist come to a diagnosis of Asperger's…

Good morning, and although the time is expired on this question, I would like to answer it anyway. I hold two masters degrees, one in Special Education and a second in Individual and Social Rehabilitation. I have a certification in Forensic Testimony and Interview, and am able to do so with people with Aspergers Disorder.

In brief, someone can use a forensic evaluator/interviewer to observe, read reports, and in turn report or recommend to the court in a custody hearing. Even so, it is normally just a tactic as having Aspergers Disorder does not make a bad parent. Being a bad parent does. If the parent with Aspergers poses no threat to the child or children, then no, it would be unethical to bar having access to the children.

I have fortunately found that parents with Aspergers and/or the rest of the Autism Spectrum have been exemplary parents. That is not a rule, but has been my experience. I would look for things such as being aware of the child and the child's safety, being able to provide a full range of oportunities for the child (i.e. that the person can leave the house to help the child to go to see a friend, etc.). Be able to provide nutritious meals, etc.

Now, to do this, I would have to conduct a rather extensive interview, followed by at least two home visits for me to feell that I am being ethical in my recommendations. If someone can also access assistance, such as a friend or relative to provide transportation to a friend (example), then it would not be a negative for that parent.

I would suggest asking how the "forensic specialist" based his or her decision. Were home visits conducted? Were things like being very literal factored in, and as such, home visits conducted? If not, I would ask your attorney to request a second expert to provide testimony. If some of the conclusions are not accurate for which the decision were based, and/or if home visits were not done, I am afraid that this was not a fair or ethical report or recommendation.
