Hi My son purchased...

Hi My son purchased second hand vehicle which has now been diagnosed with a major issue that is a result of Mitsubishi Motors substandard manufacturing practices. We have taken the vehicle for assessment, and they will not repair the vehicle.

Lawyer's Assistant: Where is this occurring? I only ask because laws can vary by state.

We have contacted the dealer with no response, and Mitsubishi requesting a replacement engine which they have done in the past as this issue is a known fault, but they have stated the vehicle is not covered under warranty as it was not a brand-new engine or installed by Mitsubishi.

I’m sorry to hear that you are having trouble.

Grant, if your son has a warranty with the vehicle still, your son will be able to raise a claim against the dealer. If that warranty has already passed its period, then there would have to be confirmation of this major defect in the engine which has resulted in the problem and then you need to raise a claim against the manufacturer.

We have approached Mitsubishi but they have rejected it as it was not under warranty

I understand how that could be frustrating.

Grant, if you have sufficient expert reports regarding this defects, and you want to pursue the claim against the car manufacturer, you need to take your case into the court with your supporting reports.

Grant, concerning the vehicle that your son had purchased, if the deal is refusing to fix it because there's no more warranty, and the manufacturer is not willing to listen to your case, then get an expert report that confirms there is a major manufacturing defect in the vehicle and then take this matter into the court.
