From Victoria. Nothing yet. Sure, we want to change the
sure, we want to change the Owners Corp managing company. We are a block of three units. the current manager start working with us in June 2020. Unit 3 owner introduces the manager as a known contact. We all signed a consent form to accept the Owners corp manager in June 2020. beginning of the financial year, at the (July 2020) AGM there was a resolution to allow to unit 3 owner to sign the contract to formalise the agreement. With the understanding that the contract is well communicated with all lot owners. But as time passed no communication happened. Until we had a lot of troubles with unit 3 and the owner's corp manager didn't act in a fair manner to all owners. Then unit 1 and unit 2 decided we should change the owners' corp manager. in August 2022. Now, the manager coming up with a contract signed by unit 3 on June 2021 (after 11 months from AGM) for three years from 2021 Financial year. There was no communication of the terms of the contract communicated to all owners at any time. Since August 2022 the manager has sold the business to another company and the full transition was to happen by December 2022. Now the manager says, there's a contract in place and to break away, we need all three units to agree and payout the remainder of the contract. This was bizarre. The question is, is this contract valid on grounds it is not communicated and signed in haste later time without communicating to all parties? Can we break this contract with 2/3 units signatures? can we recover the money for the remainder of the contract?… read more
