I had a judgement from ABSA regarding a bond account some 10 years ago. During this period there's been 2 incidences where the bank had given me notification of auction of the property. On each occasion I paid the full arrears plus the following 2 months installments in order for them not to auction off my property. I bought the property to run as a B and B 12 years ago. I am previously disadvantaged so there's been no capital in my hands, I have been on the back foot for all these years whilst ABSA holds this judgement over my head. Last year and this year things have been tough and I could not pay my bond instalments due to the economic downturn, though things are picking up again. A month ago I received a summons of notification of auction of the property - auction date 9/7. When I called ABSA legal arrangements around 13/6, they asked for the bond account number, and after discussions, was told to pay at least 70% of the arrears amount to stop the auction and the balance to arrange to settle. I was owing R312699.61 in arrears, was told to pay R218899.77 to get the auction stopped. I have been working on sourcing this amount all month, last Monday I phoned ABSA to confirm the amount to pay, ABSA legal said there now was another month's instalment added on, so the new 70% amount to pay is now R236110.00. I paid R240000 into the bond account yesterday. This morning I emailed ABSA legal arrears and the attorneys with proof of payment and asked them to confirm that the sale has been withdrawn. I in turn received an email from the attorneys stating that they want the full arrears, that I need to pay another R97000 otherwise the auction will go ahead tomorrow. I informed ABSA legal that they told me I could pay 70% of the arrears amount which I have done, that it's unethical now at the 12th hour to demand the full arrears. I have been notified that the auction will go ahead tomorrow if I don't pay the balance of the arrears in full by 9.30am tomorrow. Please advise. My name is***** … read more
