I own a small business which employs 5 permanent part time workers. On Friday 28 December, 2018, at the end of her shift, one staff member, who has been employed here for around 5-6 years asked me for one week's annual leave commencing basically from that date. It was understood and verbally agreed between us that she would have the following week off as it was not going to be a hectic week and I could cover her shifts. I also explained to her that "one week would be ok as it wasn't going to be busy but the following week would be busy and we had a lot of things to get done" that week. I arrived at work on 31st December and found a note stuck on my desk just above the computer scren that said "Dani's Holidays. Taking 2 weeks. Be back Wed 16th Jan". I was furious. She basically planned this the whole time and was very sneeky about it. We talked about having holidays in January last year and I explained to her then that January is our busiest month and that she cannot take annual leave during January. I only agreed to this year giving her the first week of January off as it would be easy enough to cover her shifts for that one week. I would like to know where I stand legally as I would like to terminate her employment. She cannot be relied on to do the right thing. She let not only me down, but her coworkers who had to work extremely hard to get through the week she did not show up. Unfortunately, we do not have any written policies regarding annual leave etc. and none of my employees are employed under any written contract.
