Good morning, I am just after some advice around a business
I am just after some advice around a business lease. At the beginning of Covid-19 I approached my landlord to see if he could provide some rent relief. Following this he obviously contacted a legal firm and arranged for a lease variation. We had not had any discussion around costs and in June 2020 paperwork was delivered to me with an attached invoice for over $2000. I believed this to be very exorbitant and contacted the legal office to clarify why it was so large. The person I was speaking with ended the conversation abruptly by hanging up on me although I don't believe that I was rude and I thought this was very unprofessional. On the 11th November I received an email advising the there has been a change in lease titles and the lease variation has not been processed and that I owe them the $2000 for the lease variation. I had not contact form them from June to November and was wondering if I have any legal rights here or am I just liable even though I believe they have been unprofessional and negligent in this process. Hello Pearl, I've almost completed the conveyancing work for the sale of my house, and have not engaged a solicitor in the process. However, I do have an agent who has organised the contract signing and deposit etc. Settlement is set for two weeks time and I have arranged with the bank the details for the day. I have a small mortgage on the property and the 'Request to Vary Security Form' is completed and with the bank. Transfer documents have been completed and are with the buyer's solicitor. I am preparing the Settlement Statement but before I send it through to the buyer's solicitor, I wish to clarify the requirements/process of the mortgage release with the Titles Office. I sold a different property about 12 months ago and in that Settlement Statement subtracted the cost of the mortgage release from the amount payable by the buyer.
