We are living in the rental property for 4 and half years. We lost the jobs and had financial hardship… Vcat order us to pay 40% of rent last year and we were paying regularly till now. The law supported us till 28th March 21. Now they have applied to VCAT to vacate the house due to 14 days rent areas and hearing is placed on 19th July. We rent a property and have been living here approx 7 years. We are up to date with our rent, our inspections are prefect, during lock down last year, we were still paying our rent, and we keep the house spic and span. We are based in Melbourne. In March the house behind us was demolished, and with the demolition, our back fence was knocked down as well. I notified the agent, who notified the land lord. It is now June 2nd, and only now has the fence been erected, In the mean time, we still paid our rent in March, and April. I did not pay the rent for May. I had advised the agent, that we were to have our daughters wedding in May, and we wanted the fence by then as we had guest over that weekend. The agency sent out a fence person for a quote early April, and then again late April. I have also told the agency to come see the pro poetry, as we have been exposed and our back years and our living area is in full exposure to people and cars in the next street. We have had no privacy, and no security. Workman are now on the vacant property, and I work from him and feel extremely vu,narable. I spoke with the agent last week and asked due to the inconvenience can we at least pay half rent for May and half rent for June, and the landlord came back with No -it wasn't their fault. I have had to cancel to events we were holding but clean try not the wedding and on the Sunday after the event I had over 60 people in our back yard. What are my rights here? My name is***** and I need some help with a rental issue. I was asked to move out as my landlord wanted to move back into the house. The landlords plan about a year ago was to demolish the house and build units on it. This didn't happen straight away. I was told by my rental manager that I had until the middle of June this year before anything would happen. I received an email in February that told me that my landlords circumstances had changed because of covid and he was having financial difficulties meaning he needed to move back in. i had to be out by the 31st of March or sooner if I could. I believed that this wasn't the truth. I thought it may have been due to my rent being late a number of times. I lost my job due to covid and had some trouble keeping up. But I still did my best. Anyway, I found a place to move to and was completely out by the 31st as requested in the email. I have read about the owner move in eviction and it stated that the landlord or a family member MUST move in and cannot do anything with the house for 3 years otherwise it is seen as a wrongful eviction. I never received a notice to vacate and now the house has been bulldozed. It is just an empty paddock now, and it has only been about 6 weeks since I moved out. I'd like some advice please on whether or not I could claim some compensation. I wasn't prepared financially to move in March. I had to use bill/loan repayments to get the bond and rent together and now I'm behind on those payments, which are continuing to add interest.
